BY USING OUR WEBSITE YOU AGREE TO THIS POLICY — PLEASE READ IT CAREFULLY.
1. Introduction
This Complaints Policy forms part of your agreement with us and explains how we handle complaints. A few key points to note:
• By making a complaint, you confirm that you believe the information you provide is accurate and complete.
This Policy explains how we handle complaints about:
• how we enforce our Terms & Conditions;
• Content on BangGuys that may be illegal or in breach of our Terms & Conditions; and
• our compliance with applicable laws.
This Policy does not apply to complaints about Content or account moderation decisions, or about copyright infringement, which are handled under the separate procedures described in Sections 4 and 5.
2. Contact Information
BangGuys is operated by EOTT Ltd, a limited company registered in England & Wales (trading as “BangGuys”).
Note on required details: The company registration number and the registered-office address of EOTT Ltd must be inserted here, as these are legally required disclosures and the address for written complaints.
Contact channels:
• Complaints / Support: bg_sup@bangguys.com
• Legal / Regulatory notices: terms@bangguys.com
3. Interpretation
Unless specifically defined in this Policy, words defined in the Terms & Conditions have the same meaning here.
4. Complaints About Content Moderation Decisions
We moderate Content in accordance with our Terms & Conditions. To complain about a decision to remove Content, deactivate an account, or issue a final warning, you must use our deactivation/appeal procedure. Appeals against a moderation decision — including any decision to remove Content, deactivate an account, or ban you because we believe you have engaged in an illegal act — are handled under our Appeals Policy (summarised in the Safety & Transparency Center).
5. Complaints About Copyright Infringement
Complaints about suspected copyright infringement are handled under our DMCA / Copyright Takedown procedure set out in the Terms & Conditions, not under this Policy.
6. How to Make a Complaint About Anything Else
You can make a complaint in any of the following ways:
• using the in-platform contact form, selecting the reason for your complaint and describing the issue;
• using the “Report” function on the relevant Content page and selecting the reason;
• emailing bg_sup@bangguys.com; or
• writing to EOTT Ltd at its registered-office address (to be inserted).
You must provide enough information for us to investigate, including any relevant URLs. If a complaint is missing important information, we may not be able to consider it properly.
7. How We Review Complaints
When reviewing a complaint:
• we review the relevant information and supporting documents you provide;
• we may request additional information or documents from you or from third parties;
• we review complaints in good faith and within any legally applicable time limit, and we aim to review and action complaints within 24 to 48 hours of receipt, and sooner where the nature of the complaint requires;
• if the complaint concerns Content that we determine materially violates our Terms & Conditions, we will remove it;
• you may be notified of the outcome — for example, removal of the Content or account, or confirmation that our decision is upheld. If we determine the Content complies with our Terms & Conditions and do not remove it, you may appeal under our Appeals Policy;
• if you wish to be informed of the outcome of an illegal-content report, or do or do not wish to receive updates, please tell us when submitting your complaint; and
• we do not disclose the existence or content of user complaints to the reported party, except where strictly necessary to process a report or appeal.
8. Abuse of This Complaints Process
We do not tolerate complaints made in bad faith, or that are abusive, harassing, or intended to harm anyone. If you are a User and make an abusive or unfounded complaint, we may suspend or terminate your account.
9. EU/EEA Consumer Mediation Services
If you are in the European Economic Area, you may — but are not required to — seek resolution of a dispute with us through consumer mediation, including via the European Online Dispute Resolution (ODR) platform. We are not obliged to participate in alternative dispute-resolution proceedings except in limited circumstances.
10. Regulatory Complaints Under the DSA (EU/EEA)
If you are in the European Economic Area and encounter an infringement of the EU Digital Services Act while using BangGuys, you have the right to complain to the Digital Services Coordinator of the country where you are located. You may also report the matter to us under this Policy and dispute our decision under our Appeals Policy.
11. Regulatory Complaints
As a service operated from the United Kingdom, BangGuys is subject to oversight by relevant UK regulators, which may include Ofcom (under the Online Safety Act 2023) and the Information Commissioner’s Office (for data protection). You may contact the appropriate regulator where you believe we have not met our obligations.
Note: The specific regulators that apply depend on the markets BangGuys serves. Confirm which authorities have jurisdiction (for example, whether the Australian eSafety Commissioner applies based on Australian users) and list them here accordingly before publication.
12. Breach of Contract Claims Under the Online Safety Act
Users in the United Kingdom are entitled to bring a breach-of-contract claim against us, including where we breach our Terms & Conditions in how we (i) take down or restrict access to your Content, or (ii) suspend or ban you from using BangGuys.
13. Your Statutory Rights
Nothing in this Policy affects your statutory rights.
